Colorado Legislation Update

An Urgent Message for Colorado Voters 

A trio of dangerous abortion/transgender bills are proceeding through the Colorado legislature right now and are likely to pass, given the near super-majority status held by progressive lawmakers in this state.
Colorado’s already existing abortion laws offer a reference point from which to consider the new legislation. Here’s a quick assessment of these pending bills:

  • SB 25-183: In effect, this bill implements Amendment 79 (which enshrined the right to abortion in the state constitution) but preserves the religious exemption for mandatory abortion coverage. Under this bill, C.R.S. § 10-16-104(26)(d) would continue to provide that “[a]n employer is not obligated to provide [abortion] coverage if providing the coverage conflicts with the employer’s sincerely held religious beliefs.”
  • HB 25-1309: Adds a new section (29) to C.R.S. § 10-16-104, which mandates employer insurance coverage of “gender-affirming care,” including social, psychological, and medical interventions for adults and children. This includes hormone therapy, genital surgeries, breast augmentation and reduction, and more — without any age minimums.
    • Unlike subsection (26) pertaining to abortion, there is no religious exemption for mandatory transgender coverage.
  • HB 25-1312: Contains three major components:
    • Sections 2 and 3 of the bill allow the state to remove a child from his or her parents if the parents are insufficiently “affirming” of the child’s “gender identity.”
    • Sections 4–6 of the bill pertain to public schools and public school teachers.
    • Sections 7 and 8 define two new forms of discrimination:
      • Deadnaming – referring to a person by their “birth name” rather than “chosen name.”
      • Misgendering – using pronouns that “conflict” with someone’s “gender identity.”
      • These would be prohibited in places of public accommodation under the Colorado Anti-Discrimination Act (CADA).
      • A public accommodation includes most public places, but not religious institutions. (C.R.S. § 24-34-601(1))
